Intellectual Property

The website Lakewell.com is the exclusive property of Lakewell NV (herafter Lakewell), which therefore holds all the intellectual property rights relating thereto. The intellectual property includes but is not limited to trademark and copyrighted content, including text, images, names, logos, patents, videos, product designs and manufacturing methods.
Consequently, its content may not be modified, copied, distributed, reproduced, downloaded, displayed, published, communicated or sold in any form or by any means whatsoever, in whole or in part, without the prior written consent of Lakewell.

Lakewell retains full and exclusive title to all trademarks, registered designs and copyrights attached to the products provided by or accessible through the website, as well as all other intellectual property rights relating to Lakewell.

If, with respect to these Terms of Business, the customer infringes or is likely to infringe the aforementioned rights, Lakewell reserves the right to take all appropriate measures for such disturbance to cease. Lakewell also reserves the right to suspend or delete the customer‘s registration on the website or to block its access thereto.

The mention of vehicle brands, models and part numbers on the website is for reference and comparison purposes only. Lakewell is not an official representative of any vehicle brand and does not act on their behalf. The vehicle brands, models and part numbers are trademarks held by their respective supplier manufacturers.


Transfer of ownership

Ordered products remain the property of Lakewell until they are handed to the carrier.

All risk of loss or damage to the products is transferred to the customer at the moment when the customer, or a third party designated by the customer, physically takes possession of these products.
In case of product return, the products remain property of the customer until they are received and inspected by Lakewell.
The customer shall bear the direct costs of returning the products and shall be liable for any depreciation in the value of the products resulting from handling.


Limitation of Liability

Lakewell declines all liability in the event of the unlawful use or operation of all or part of the content of the website. Lakewell shall also not be liable towards customers for any loss or damage they may suffer as a result of their failure to communicate accurate information to Lakewell or by not keeping their account information safe.

The website may contain hypertext links to other websites that are not owned or controlled by Lakewell. Lakewell has no control over the content, data protection charters or practices of third party websites and declines all liability in this respect. Lakewell is not responsible for the availability of these external websites and resources, and does not endorse any advertising, products or other materials on or accessible through these external websites or resources.

Lakewell shall not be liable for any loss of any kind, whether it be personal injury, physical or economic loss, which could result from the installation, use, misuse or wear and tear of the products sold.

Lakewell warrants the conformity of its products as per product descriptions and specifications. Lakewell shall not be liable for any use that is contrary to these specifications.

The customer assumes all liability other than that of conformity of the products as per product descriptions and specifications, and in particular with respect to the suitability of the products for their requirements and the use and operation of the products.

The customer expressly acknowledges that Lakewell has provided them with all information required for them to assess the suitability of the products for their needs, and to take all necessary precautions for their implementation and use.
Customer agrees to and hereby does indemnify, release, defend and hold Lakewell, its directors, employees and shareholders harmless from and against all claims, damages, losses, costs and expenses arising in favor of any person, firm or corporation on account of personal injury or property damage alleged to be caused by the products.


Disputes

These Terms of Business are governed by Belgian law.

In the event of any disputes that may arise regarding the validity, application, performance, suspension or termination of these Terms of Business, the Parties shall apply their best efforts to reach an amicable solution and agree to refrain from publicly exposing any disputes in social media or the internet at large. Such disputes may also be submitted to consumer mediation. The customer however, remains free to accept or reject the use of consumer mediation.

The Parties may also visit the European dispute resolution platform through the following link. The solution proposed by the mediator is not binding on the Parties.

Any dispute between the Parties arising out of the construction or execution of these General Terms of Business for which it has not been possible resolve amicably or through mediation, shall be brought before the competent courts in the defendant’s place of residence or where the place of performance of the General Terms of Business is located.
